Indian prisons need gender-sensitive reform as women inmates face double marginalisation

Image
In a  judgement  last month, the Supreme Court expressed discontent over the lacunas in the administration of death in India. Pursuant to a report by Justice SK Panigrahi which revealed that the toilets in prisons of Odisha were not fit for human usage and the food being provided was not fit for human consumption, the high court  pulled up  the state government to take steps towards improving the living conditions of inmates. In yet another case, the Jammu and Kashmir High Court  set out  to rectify the problem of overcrowding in prisons. It is clear from these repetitive judicial interventions that the prison administration system in India is broken and requires some fixing. But whether the road to reform is common for male and female inmates is a question that is rarely asked. But this question needs to be asked because women inmates face double marginalisation both inside and outside of prisons. First strand of marginalisation The treatment of women in Indian society is riddled w

2002 Gujarat riots: Amit Shah lauds SC verdict, takes jibe at Congress' satyagraha over ED questioning Rahul Gandhi

Lauding the Supreme Court verdict which dismissed a plea challenging the clean chit given by an SIT to then Gujarat Chief Minister Narendra Modi in the 2002 riots case, Union Home Minister Amit Shah took a jibe at Congress' 'satyagraha' over ED questioning Rahul Gandhi in the National Herald case and said that Modi appeared before the SIT in relation to probe over violence but the BJP did not resort to "drama or dharna" during the questioning. Shah said that those who levelled "politically motivated" allegations against PM Modi should apologise for it. He noted that Modi presented an ideal example for all political persons of how to respect the Constitution. "In a democracy, PM Modi presented an ideal example of how the Constitution should be respected by all political persons. Modiji was also questioned, but nobody protested, and (BJP) workers from across the country did not gather in solidarity with Modiji. We cooperated with the law. I was also

As US Supreme Court scraps Roe vs Wade, a look at how abortion laws have evolved in India

Image
Protests have erupted across the United States after the country’s Supreme Court overturned its 50-year-old Roe vs Wade decision , now denying women the constitutional right to abortion. President Joe Biden called the ruling a “tragic error”, saying that it has taken the country back 150 years. The verdict comes after a leaked report in early May revealed that the US top court would strike down Roe vs Wade. Friday’s decision has thrown light on abortion legislation in other countries , including India, where abortion under certain circumstances has been legal for the past 50 decades. In the wake of the developments in the US, we take a look at what our law says and how India decided to allow abortions. The role of the Shantilal Shah Committee Until the 1960s, abortion was illegal in India under Section 312 of the Indian Penal Code, 1860. “Causing miscarriage of a woman” was a punishable crime with imprisonment of up to three years and/or a fine. In the mid-1960s, the government s

Neighbourhood concern: Beware of growing Chinese, Pakistani and Islamist bogeys in Bangladesh

During a recent conversation with Maroof Raza on his talk show  Latitude  which discussed India-Bhutan ties in the backdrop of China’s shadow, I lamented that India’s ‘Neighbourhood First’ policy needs serious reworking. Raza responded by saying something rather interesting which drove home the point about the ineptitude of India’s foreign office. He said, “India has a diplomatic corps which is smaller even than that of Singapore but we are trying to punch in the heavyweight category of world’s geopolitics.” He, of course, stated it in the context of the need for India to engage more seriously with our neighbourhood lest India alienates even Bhutan, the only true friend and ally that India has in South Asia. But even as the dialogue was, primarily, about the manner in which China was making robust inroads into the Himalayan kingdom and my analysis that a “generational shift” in Bhutan may be becoming more open to Chinese socio-economic overtures, the fact that Raza sought to sagely co

On this day: Indira Gandhi declared Emergency; all you need to know

“The President has proclaimed Emergency. There is nothing to panic about.” - When Prime Minister Indira Gandhi proclaimed these words on All India Radio, few were aware that it would be the start of a dark period in Indian politics. Gandhi made the announcement just hours after then President Fakhruddin Ali Ahmed signed the order on her advice late night on 25 June. As the nation recalls one of the most tumultuous periods in its history since independence, here’s a look at all you need to know about the Emergency: The build-up: While Gandhi was wildly popular in the domestic arena after India’s victory over Pakistan in the 1971 war, she had to face several issues - scarcity of food, growing unemployment and rampant inflation. The situation was further compounded by student protests led by Jayaprakash Narayan, which lambasted the corruption under the Congress rule and demanded Gandhi’s resignation. In another development, Gandhi’s win in the 1971 Rae Bareli parliamentary elections c

First Read | Story of reversion to Sanatan Dharma by a convert that could be a lesson for many

Image
Nearly a decade ago, Kasargod in Kerala was in news with several reports of conversions of Hindus, especially girls, into Islam. One of those who got converted was a girl named Sruthi. Born into a Havyaka Brahmin family in Kasargod, Sruthi became Rahmat after getting converted to Islam. However, she eventually reconverted and came back to the fold of Hindu Dharma. How did this happen? This intriguing and thought-provoking journey has been penned in an autobiographical format by her. It is an important read as it provides a first-hand account of the well-oiled ‘Conversion Industry’ run by Islamists and Christian Missionaries in India. This autobiography was originally written in Malayalam and was first published in 2018. The book has been hugely popular in Kerala but ironically, no one heard about it outside the state. Now with the English translation of this book coming out as ‘Story of A Reversion’, it can surely help in kicking off a debate on this issue in the larger national conte

Biodiversity preservation is an urgent imperative and must move from talk to large-scale credible action

Biodiversity is the variety of living species of flora and fauna. Without it, we would have no agriculture, forestry, or life as we know it. Halting biodiversity loss is a must for human survival. In doing so, we invest in people, their lives, their wellbeing, the ecosystem, and in the shared environment we live in. India is the world's eighth most biodiverse region with a 0.46 BioD score on diversity index, 102,718 species of fauna and 23.39 per cent of the nation's geographical area under forest and tree cover in 2020. India — a megadiverse country with only 2.4 per cent of the world's land area — accounts for 7-8 per cent of all recorded species including over 45,000 species of plants and 91,000 species of animals. These 91,000 animal species represent about 6.5 per cent of the world's fauna. These include 60,000 insect species, 2,456 fish species, 1,230 bird species, 372 mammal species, over 440 reptile species, 200 amphibian species with largest concentration in W

Past and prejudice: Manusmriti is neither anti-Dalit, nor pro-Brahmin

Slavery not only affects people financially and physically but also handicaps them intellectually. One of the most serious consequences of slavery is that it degrades and corrupts the ruled culturally and civilisationally. Generations of people are made subservient, both physically as well as culturally. The same phenomenon happened with Hindus, whose Sanatana culture was severely assaulted by foreign rulers before Independence, and post-1947 court historians and scholars distorted the idea of Bharat for new generations. The  Manusmriti  is an apt example of how a sacred text is demonised and through it the entire Sanatana Dharma has been put in the dock. The  Manusmriti , the oldest of the smritis, determined ‘varna’ based on “talents, jobs, and abilities rather than birth”. Manu says that a Brahmin may become a Shudra and vice versa based on his characteristics, deeds, and talents. Similarly, there can be an interchange between Kshatriyas and Vaishyas. Ironically, nowadays, the wor
