Delivering a lecture in Gujarat, Justice Chandrachud also said that use of state machinery to curb dissent instills fear, which violates the rule of law. "The blanket labelling of dissent as anti-national or anti-democratic strikes at the heart of our commitment to protect constitutional values and the promotion of deliberative democracy," he said. Protecting dissent is but a reminder that while a democratically elected government offers us a legitimate tool for development and social coordination, they can never claim a monopoly over the values and identities that define our plural society, Justice Chandrachud said. When it comes to Kashmir, I don't know how it ends, but let's make sure that two democracies will end it differently. If you can prove that concept here, then I think that's probably the best way to sell democracy," the Republican leader said. To this, Jaishankar promptly responded, "Do not worry, Senator. One democracy will settle it and you know which one." During the discussion Jaishankar also said that the United Nation

Reservation fufils demand of substantive equality under Article 16(1) of Constitution; states duty-bound to offer it to disadvantaged groups

The Supreme Court of India recently ruled that states are not legally bound to provide reservation to Scheduled Castes and Scheduled Tribes in government jobs. In its decision last week on Friday, the top court also stated that individuals do not have a fundamental right to claim reservation in promotions. The ruling came against a Uttarakhand High Court order where the apex observed that “In view of the law laid down by this court, there is no doubt that the state government is not bound to make reservations. There is no fundamental right which inheres in an individual to claim reservation in promotions. No mandamus can be issued by the court directing the state government to provide reservations," the bench said in its order. The state governments can grant reservation to Scheduled Castes and Scheduled Tribes at their own discretion, but will have to collect quantifiable data which shows their inadequate representation in public services.
